abstract The purpose of the present invention is to provide a phosphor and a light-emitting device using the phosphor. The phosphor has a broad fluorescent spectrum which can obtain white light having a low colour temperature nearly independently by combination with a blue LED, and is beneficial for high colour-rendering properties. The phosphor also has high light-emitting efficiency and possesses the characteristics of conventional nitride phosphors of thermal and chemical stability and little loss of brightness at high temperature. The present invention provides β type sialon represented by the general formula: Si 6-z Al z O z N 8-z :Eu(0<z<4.2). This β type sialon has a P2/P1 ratio of 0.5 to 1000 (wherein, P1 is the height of the absorption line appearing at g=2.00±0.02 in the first derivative type spectrum obtained by electron spin resonance at 25°C, and P2 is the difference between the maximum value and minimum value in the spectrum, on the lower magnetic field side than P1).
