abstract The Zea mays c.v. B73 ubiquitin-1 (Z. mays c.v. B73 Ubi-1) promoter drives high-level constitutive transgenic gene expression in plants. Reuse of the same maize c.v.B73 Ubi-1 promoter in multiple gene constructs may also result in gene silencing, thus making the transgenic gene less effective. The present invention proposes gene-regulated promoter elements, constructs, and methods for expressing a transgene in a plant cell and/or plant tissue using a gene-regulating element derived from the Ubi-1 promoter of different maize genotype maize c.v.b104.
