abstract The object of the present invention provides a fluorescent substance which can independently obtain white light having a low color temperature in a near form by means of combining blue LED, and has a broad fluorescence spectrum advantageous to color rendering properties, a high luminescence efficiency, a thermal.chemical stability that is a characteristic of a known nitride-based fluorescent substance, and a low luminance decay under high temperature; and a light emitting device using thereof. The present invention is β -Sialon represented by Si6-zAlzOzN8-z: Eu (0 < z < 4.2). The β -Sialon has P2/P1 (in formula, P1 is the height of absorption line appeared in g=2.00 ± 0.02 in the first derivative spectrum obtained by the electron spin resonance method at 25 DEG C; P2 is the difference between maximum and minimum in the spectrum having the lower magnetic field side than P1) of 0.5 to 1000.
