abstract The present invention provides a lithium transition metal oxide having a layer structure, which can increase the output of a battery, particularly as a positive electrode active material for a battery mounted on an electric vehicle or a hybrid vehicle. SOLUTION: General formula Li 1 + x M 1-xy M ′ y O 2−δ (where M is an element of Mn, Co and Ni or a combination of two or more thereof) Element M. is a transition element existing between Group 3 elements of Group 11 of the Periodic Table, or an element composed of a combination of two or more thereof. The oxygen structure occupancy obtained by the Rietveld method is 0.982 <oxygen occupancy ≦ 0.998, the crystal structure belonging to the trigonal crystal of the space group R-3m, and the 3b site A lithium transition metal oxide having a layer structure is proposed in which the distance between −6c sites is 1.95 cm <3b sites−6c site distance ≦ 2.05 mm.
