abstract Provided is a method capable of processing a polymer liquid crystal film into a staircase shape while avoiding the formation of protrusions. Also provided are an optical element and an optical head device having excellent optical characteristics. An alignment film and a polymer liquid crystal film are formed on a transparent substrate. Next, after the first protective film 4 and the first resist 5 are formed, the first protective film 4 and the polymer liquid crystal film 3 are etched using the first resist 5 as a mask. By repeating this, the polymer liquid crystal film 3 is processed into a staircase shape. The first protective film 4 can be a polyimide film or an organic siloxane film. [Selection] Figure 2
