A positive electrode side active material for a non-aqueous electrolyte secondary battery having at least a lithium transition metal composite oxide having a spinel structure, wherein the magnesium content in the surface of the lithium transition metal composite oxide is 70% or more. A positive electrode active material for a non-aqueous electrolyte secondary battery, wherein lithium is present at the 16c site of the crystal structure of the lithium transition metal composite oxide.
