A non-aqueous electrolyte secondary battery using a positive electrode active material having at least a spinel-structure lithium transition metal composite oxide, wherein the lithium transition metal composite oxide is primary particles and aggregates thereof. Present in the form of particles consisting of one or both of the secondary particles, each particle has two-dimensional coordinates having coordinate components of the third root of the emission voltage value caused by the transition metal and lithium in each particle. A non-aqueous electrolyte secondary battery in which the absolute deviation of the error of each point with respect to the primary regression line is 0.25 or less when a primary regression line passing through the origin is obtained and expressed as a point on the coordinate plane .
