To SOLUTION: The non-aqueous electrolyte battery of the present invention uses a graphite for a negative electrode, uses a material capable of inserting and removing lithium ions for a positive electrode, and includes a non-aqueous electrolyte comprising a solute and an organic solvent. . The graphite used for the negative electrode has at least a crystallite having a hexagonal structure and a crystallite having a rhombohedral structure, and has a peak intensity of (101) plane obtained by an X-ray diffraction method using a Cu-Kα ray source having a rhombohedral structure.
